Terms of use
I. Use of BIÖG online services
The following general terms of use apply to use of the BIÖG websites, as well as the supplementary terms of use for individual services (e.g. subscriptions to RSS feeds; use of widgets), the applicability of which the user agrees to.
II. Content of BIÖG online services
- The BIÖG's online services contain its own and third-party content as well as links to third-party providers. Insofar as users can publish their own contributions within the framework of individual services on the BIÖG website, these contributions reflect the personal opinion of the user concerned and are not necessarily aligned with the opinion of the BIÖG.
- The BIÖG accepts no liability for the up-to-dateness, accuracy or completeness of the information provided or linked to by it or by third parties. All services are subject to change and non-binding. Liability claims against the BIÖG vis-à-vis direct or indirect losses of a material or non-material nature caused by the use or non-use of the information provided or linked to are categorically excluded. Nor does the use of the online content create any rights or obligations between the BIÖG and the user of the online content or third parties.
- The BIÖG expressly reserves the right to change, supplement or delete the services (or aspects thereof) without prior notice or to temporarily or permanently cease publication
III References to other websites (links)
- The BIÖG is responsible for its own content that it makes available for use in accordance with general legislation. This content is to be distinguished from cross-references (links) to content provided by other providers. Cross-references to other providers are identified visually. The BIÖG is only responsible for these providers' content if it is positively aware of this content (including illegal or criminal content) and if it is technically possible and feasible for it to prevent use of such content.
- Links are dynamic references. Although the BIÖG checked the third-party content when the link was first created to determine whether it could give rise to civil or criminal liability, it is neither obliged nor in a position to constantly check the content to which it refers on its website for changes that could give rise to new liability. Only if the BIÖG establishes or is informed by others that a specific service to which it has provided a link gives rise to civil or criminal liability will it remove the link to this service, insofar as this is technically possible and reasonable.
IV. Copyright and labelling law
1. Third-party rights
- The BIÖG endeavours to observe the copyrights of the photos, illustrations, audio recordings, video clips and texts (hereinafter: items) used in all publications, to use items that it has created itself or to make use of licence-free items. All brand names and trademarks mentioned on the website and possibly protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the relevant registered owners. It should not be assumed that the names used are not protected by the rights of third parties simply because they are mentioned.
- The responsibility for observing these rights lies with the users. The copyright for published items created by the BIÖG itself remains solely with the author of the relevant items. Reproduction or use of such items is not permitted without the consent of the author or the BIÖG.
2. Own rights
The contents of this website are protected by copyright. All rights are reserved. This applies to the entire website, its individual parts, graphics, layouts, logos, photos, films, software, texts and other content. It is categorically not permitted to make the website or parts thereof available on third-party websites and networks. Framing (displaying this website in your own frame) constitutes misuse of third-party content and is not permitted. Prior written permission must be obtained for the reproduction of text and multimedia data (audio, images, programmes, etc.).
V. Data protection
If there is an option to enter personal or business data (email address, names, addresses, etc.) within the online services, this data is entered by the user on an expressly voluntary basis.
Please also note the data protection statement, which provides information on the data stored by the system in the context of its use.
VI Legal validity of this disclaimer
This disclaimer is to be regarded as part of the online service from which you were referred to this page. If sections or individual terms of this statement are not, are no longer or are not entirely legal or correct, the content or validity of the other parts shall remain unimpaired by this fact.
VII. Applicable law
German law applies exclusively to all legal relationships between the user and the BIÖG.
VIII. Severability clause
Should one of the aforementioned provisions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purport and purpose of the invalid provision in a legally effective manner. The above provision shall apply mutatis mutandis in the event of legal loopholes.
